Terms

1. Who we are

Jobwinch is a service of MoldMind LLC, a Connecticut limited liability company (“Jobwinch”, “we”, “us”). MoldMind LLC is the contracting party on every Jobwinch agreement and invoice. MoldMind LLC also makes inspection software under the MoldMind name; Jobwinch is its separate service for HVAC and plumbing contractors.

2. The service

For HVAC and plumbing contractors (“you”) outside Texas, we:

• set up and manage Google Local Services Ads and Google Search ads in your own Google accounts;
• keep your Google Business Profile up to date;
• build and host a website on your domain;
• give you a phone number and our app: lead inbox, missed-call text back, an automated booking assistant, visit reminders, quote follow-ups, review requests to every finished job, and a results page.

One contractor per trade per area. While you are a client we don't take on another contractor in your trade for the ZIP codes in your agreement. This binds us only; it doesn't control who else bids in Google's ad auction.

3. Price and billing

• $1,000 a month, no setup fee. Billing starts on go-live day: the first day your Google Search ads serve at the full budget.
• Google ad spend is separate and paid by you directly to Google, at least $2,000 a month. We never mark it up.
• Founding clients (our first 3): $750 a month for the first 3 months, then $1,000, in return for a short video about your results.
• Connecticut clients are charged Connecticut sales tax where it applies.

4. Minimum term and cancelling

The minimum term is 60 days from go-live day. After that it's month to month: cancel by email to support@jobwinch.com, effective at the end of that billing month. If you leave, you keep your Google accounts, your domain and a free static copy of your website, and we help you move the phone number.

5. The guarantee

15 Qualified Leads in your first 60 days live, or we refund the fees you paid us for those 60 days and keep working. Your Google ad spend is paid to Google and is not part of the refund.

What counts as a Qualified Lead

A lead counts if it is one of these:

• a Local Services lead that Google charged you for and did not credit back, checked on day 75, after Google's 30-day credit window;
• a first-time caller to your Jobwinch number (a number not seen before go-live, not in the customer list you gave us, and not marked “existing customer”) whose call lasts at least 60 seconds, from any source; or
• a form sent from your website;

and in every case it is not spam, not a repeat contact within 7 days, and inside your service ZIP codes.

The four conditions

The guarantee applies while all four hold:

1. Your Google ad budget stays on and unpaused at $2,000 a month or more.
2. Our access to your Google Ads, Business Profile and website stays connected.
3. You respond to every lead by the end of the same business day.
4. You mark your leads in the app (Booked, Existing customer or Spam).

If a condition slips, we tell you in writing and you have 5 business days to fix it before the guarantee lapses.

Clock pauses

If Google pauses your ads for a reason that isn't yours, like a verification review, the 60-day clock pauses too, day for day. You see every pause in the app. Pauses caused by you (a budget cut, a failed payment, removed access) don't pause the clock.

Counting and refund

We do the final count on day 75 after go-live (plus any paused days), from the lead list in your app. If you are short of 15, we refund the fees you paid us for those 60 days, whole invoices, and keep running the service until you reach 15. The refund is your sole remedy for missing the guarantee.

6. Texting and the assistant

• You are the sender of record: texts to your customers go out under your business name, from your Jobwinch number.
• The assistant says it is an automated assistant, never quotes prices, and never confirms a visit until you do.

7. Your accounts and data

Your Google Ads, Local Services, Business Profile, domain and phone number are yours. On request we export your data within 30 days. Our handling of personal information is in the Privacy Policy.

8. Limits

EXCEPT FOR THE GUARANTEE REFUND, OUR TOTAL LIABILITY IS LIMITED TO THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Google decides where and whether ads show; we don't control Google's auction, reviews or policies.

9. Law

Connecticut law applies. Disputes go to the state courts in the Hartford Judicial District.
